Grievance mechanisms are essential channels through which individuals can report concerns regarding negative impacts arising from business activities. However, while standard mechanisms focus on merely handling and resolving complaints, a human rights-based approach is designed to systematically identify and address adverse human rights impacts. These impacts occur when actions or omissions reduce an individual’s ability to enjoy their human rights, including the right to decent living and working conditions.
Whether you are building a new system or adapting an existing one, the checklist helps you evaluate if your mechanism is "fit-for purpose". While adapting existing grievance systems can reduce set-up costs and implementation time, legacy designs may lack the scalability or sensitivity required for severe cases.
Use the checklist to ensure that your grievance mechanism provides a clear pathway to safe reporting, meaningful engagement, and effective remedy under a human rights framing. Human rights–based mechanisms are guided by principles set by the 'UN Guiding Principles on Business and Human Rights', including accessibility, trust, fairness, and accountability, and are grounded in the experiences and needs of affected individuals.
Transitioning to a human rights-framed mechanism moves your channel beyond a "tick-box" exercise, turning the process into a powerful risk management tool. Human rights-based mechanisms enable businesses to:
• Spot issues early before they cause significant harm to individuals and/or disrupt operations
• Prevent escalation, thereby reducing legal, financial, and reputational risks
• Meet global compliance standards, including the UN Guiding Principles and emerging Human Rights Due Diligence regulations
• Improve stakeholder relations by fostering trust and meaningful dialogue
